ELMPEAK — PRIVACY POLICY
Hi there!
If you're reading this, you probably care about your privacy — and honestly, we respect that. This page explains how we collect, use, and protect your information when you use our website, our services, or interact with us in any way. We've done our best to keep this simple and jargon-free, because nobody enjoys reading legal documents (including us).
Elmpeak ("us," "we," "our") operates the elmpeak.co website and provides managed executive assistant services (EA Teammate), the PeakFlow AI-powered business platform, and systems building services. We'll refer to all of these collectively as the "Service."
The main reason we collect your information is to provide and improve the Service for you. By using the Service, you agree to the collection and use of information as described in this policy.

Information We Collect
We collect a few different types of information to make sure we can do our job well. Here's what we gather and why:
Personal Information When you use our Service — like booking a discovery call, signing up for PeakFlow, or contacting us — we may ask for information that helps us identify or reach you. This might include your name, email address, phone number, business name, website, and the industry you're in.
If you become a client, we'll also collect business details needed to set up your service — things like your hours of operation, services offered, pricing, and team member info. This is all so we can configure your platform or match you with the right EA Teammate.
Payment Information We use trusted third-party payment processors to handle billing. We don't store your credit card number or bank details on our servers. Your payment information goes directly to our payment providers, who are required to keep it secure.
Usage Data When you visit our website, we automatically collect some technical info — like your browser type, the pages you visited, how long you spent on those pages, and your device info. This helps us understand how people use our site so we can make it better.
Cookies Cookies are small files stored on your device by websites — they help us remember your preferences, understand how you use the site, and improve your experience. Most websites use them, and so do we.
You can always tell your browser to refuse cookies, but heads up — some parts of the site might not work as smoothly if you do.
We use a few types of cookies:
Session Cookies: Temporary cookies that help the site work during your visit. They disappear when you leave.
Preference Cookies: These remember your settings so you don't have to re-enter them every time.
Analytics Cookies: These help us see which pages are popular and how visitors move through our site.
Information Collected Through PeakFlow
If you're a PeakFlow client, the platform processes data on your behalf as part of the service. This may include:
Call recordings and transcripts from the Voice AI Receptionist
Chat conversations from the AI Chatbot
Contact information for your clients and leads stored in the CRM
Appointment and calendar data
Emails and SMS messages sent through automation workflows
Analytics and performance data
Important: This data belongs to you. You are the owner (data controller) of your customer information. We process it on your behalf to deliver the service. We don't use your customer data for our own marketing or share it with anyone outside of what's needed to run your platform.
How We Use Your Information
Here's what we do with the information we collect:
Provide, maintain, and improve the Service for you
Set up and configure your PeakFlow platform or match you with an EA Teammate
Train and optimize AI agents to work specifically for your business
Process payments and manage billing
Communicate with you about your account, updates, and support
Send you monthly performance reports and strategy recommendations
Analyze website usage to improve our site
Comply with legal obligations
What we DON'T do:
We don't sell your personal information. Ever.
We don't use your data for purposes unrelated to providing our services.
We don't spam you. If you get an email from us, it's because it's relevant to your service.
How We Share Your Information
We're careful about who gets access to your information. Here are the situations where we might share it:
Service Providers We work with trusted third-party companies to help us deliver our services — things like cloud hosting, payment processing, phone and SMS services, email delivery, and website analytics. These companies only access your data to do their job, and they're required to keep it secure. We don't share the names of our specific technology providers publicly, but rest assured they're all industry-standard, reputable platforms.
With Your Permission If you ask us to share your info with someone — like connecting your platform to a third-party tool — we'll do so with your explicit consent.
Legal Requirements We may share information if we're legally required to — like in response to a court order or government request. We'd only do this if we genuinely believe it's necessary.
Business Transfers If Elmpeak is ever acquired or merged with another company, your information may be transferred as part of that deal. We'd notify you before that happens.
Data Retention
We keep your information for as long as it's needed to provide our services:
Active clients: Your data stays as long as you're with us.
After you cancel: We keep your data for 30 days after termination so you can request an export. After that, it's permanently deleted.
Website analytics: Kept in aggregate (anonymized) form for up to 24 months.
Payment records: Kept for up to 7 years for tax and accounting purposes. Want your data deleted sooner? Just email us at team@elmpeak.co and we'll take care of it.
Data Security
We take your data security seriously. We use encryption (SSL/TLS) to protect data in transit, limit who on our team can access your information, and work with secure, reputable infrastructure providers.
That said, no system is 100% bulletproof. We'll always do our best to protect your data, but we can't guarantee absolute security — no honest company can.
Your Rights
Depending on where you live, you may have the right to:
Access your data — ask us for a copy of what we have
Correct inaccurate information
Delete your data — request that we remove it Restrict how we process your information
Port your data — get it in a format you can take elsewhere
Object to certain processing, like marketing emails To exercise any of these rights, email us at team@elmpeak.co. We'll respond within 30 days.
California Privacy Rights
If you're a California resident, the California Consumer Privacy Act (CCPA) gives you additional rights, including the right to know what personal information we collect, request deletion, and opt out of data sales. For the record: we don't sell personal information, so there's nothing to opt out of.
Children's Privacy
Our Service is designed for business owners and professionals. We don't knowingly collect information from anyone under 18. If we discover that we have, we'll delete it immediately.
Links to Other Sites
Our website may include links to other sites that aren't operated by us. If you click on a third-party link, you'll be taken to their site. We recommend checking their privacy policy — we don't control what they do with your data.
SMS and Text Message Consent
If you provide your phone number and consent to receive text messages from Elmpeak, you agree to receive SMS notifications, appointment reminders, and occasional marketing communications. Message frequency varies. Message and data rates may apply. You can reply STOP at any time to unsubscribe. Reply HELP for assistance.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we'll post the updated version on this page with a new "Last Updated" date. If the changes are significant, we'll let our active clients know via email.
